Terms of Service

1. Agreement to these terms

These Terms of Service (“Terms”) are a legal agreement between you and OpenRydr LLC, a Minnesota limited liability company (“OpenRydr,” “we,” “us”). They govern your use of the OpenRydr mobile app, the OpenRydr website (openrydr.com and openrydr.app), and related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use OpenRydr. By using the Service, you represent that you are 18 or older. If you ride a motorcycle, you are responsible for holding any license, endorsement, registration, and insurance required where you ride.

3. Your account

You sign in using Sign in with Apple or Sign in with Google. You are responsible for the activity that happens under your account and for keeping your sign-in method secure. Provide accurate information, and keep your safety-contact details current if you use the safety features.

4. License to use the Service

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the OpenRydr app for your own non-commercial riding and navigation. You may not copy, modify, reverse-engineer, resell, or commercially exploit the Service except as allowed by law, and you may not use it to build a competing product or to scrape or harvest data from it.

5. Subscriptions, billing, and trials

OpenRydr offers a free tier and paid subscription tiers, as described in the app.

  • In-app purchases (iOS and Android) are sold and billed by Apple or Google under their terms. Web subscriptions are sold by OpenRydr and processed by Stripe.
  • Auto-renewal. Paid subscriptions renew automatically at the end of each period until cancelled. You can cancel anytime — through your Apple or Google account for in-app purchases, or through the Stripe customer portal for web subscriptions. Cancellation takes effect at the end of the current billing period.
  • Free trial. New users may be offered a 30-day Premium trial that does not require a card. If you do not subscribe, your account moves to the free tier when the trial ends.
  • Refunds. Refunds for in-app purchases are handled by Apple or Google under their policies. Refunds for web subscriptions are handled by us through Stripe in accordance with applicable law.
  • Price changes. We may change subscription prices; changes apply to future billing periods, and we will give notice where required.

6. Safety features — important disclaimers

Please read this section carefully. It describes the limits of OpenRydr's navigation and safety features.

  • Navigation is an aid, not a substitute for your own judgment. Routes, directions, maps, speed displays, and points of interest may be inaccurate, incomplete, or out of date. You are solely responsible for riding safely and legally — obeying all traffic laws and signals, watching the road, and accounting for weather, traffic, and road conditions. Do not operate the app in a way that distracts you from riding.
  • Crash detection and Safety SMS are best-effort and may fail. These features depend on things outside our control — including sensor accuracy, your phone being powered and functional, cellular or data coverage, carrier delivery of messages, and correct contact information. They may fail to detect an event, may produce false alerts, or may fail to deliver a message. They are not a guaranteed emergency-response service and are not a substitute for calling 911 or local emergency services. Do not rely on them as your sole means of getting help.
  • Assumption of risk.Motorcycling is inherently dangerous. You understand and accept the risks of riding, and you use OpenRydr's features with that understanding.

Authorization to add safety contacts

When you add a person as a safety contact and provide their phone number — or change an existing contact's number — the app requires you to affirmatively confirm, for that specific contact at that time, that you have their permission to provide their number to OpenRydr and to receive automated ride-safety and crash-alert text messages from OpenRydr at that number. The contact cannot be saved without this confirmation, and OpenRydr records it (a timestamp and the version of the confirmation text). By providing that confirmation you represent and warrant that you have obtained the contact's permission. You are responsible for keeping your safety contacts' information accurate and for removing any contact who no longer wishes to receive these messages. OpenRydr relies on your confirmation that you have obtained this permission.

7. Text messages (SMS)

Some OpenRydr features send text messages (SMS). There are two distinct kinds, and they work differently:

  • Messages you send from your own phone.Routine ride-start and arrival notifications are sent using your device's own messaging app, from your own phone number — you tap send. These are ordinary text messages from you, and OpenRydr does not transmit them on your behalf.
  • Automated safety messages OpenRydr sends. If crash detection triggers and you do not cancel the alert, OpenRydr sends an automated crash-alert SMS to your safety contacts from an OpenRydr messaging number, through our messaging provider. These messages exist so that help can be reached when you may be unable to use your phone.

For the automated safety messages OpenRydr sends from its own number:

  • Consent.When you add each safety contact (or change their number), you affirmatively confirm that you have that contact's permission to receive these automated messages, and OpenRydr records that confirmation — see “Authorization to add safety contacts” in Section 6. By enabling crash detection and adding safety contacts, you authorize OpenRydr to send automated crash-alert messages to those contacts on your behalf.
  • Frequency. Message frequency varies; these messages are sent only when a safety event is detected, and are not marketing messages.
  • Opt-out and help. A recipient can reply STOP to a message to stop receiving further OpenRydr safety messages, or HELP for help. A contact who opts out may no longer receive OpenRydr safety alerts, including crash alerts — so only add contacts who have agreed to receive these messages.
  • Rates.Message and data rates may apply, depending on the recipient's mobile carrier and plan.
  • Delivery. OpenRydr and your wireless carrier are not liable for delayed or undelivered messages. Message delivery depends on carrier networks and is not guaranteed (see the safety disclaimers in Section 6).

8. Your content and community conduct

  • Your content.You keep ownership of the content you create — including rides you publish, routes, reviews, comments, profile details, and photos (“Your Content”). You grant OpenRydr a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely to operate and provide the Service (for example, to show a community route you published, or a ride you marked public). This license ends when you delete the content or your account, except for content others have already saved or shared and for reasonable backup retention.
  • Responsibility. You are responsible for Your Content and represent that you have the rights to share it and that it does not violate these Terms or the law.
  • Acceptable use.Do not post content that is unlawful, harassing, hateful, infringing, deceptive, or harmful; do not impersonate others; do not misuse the safety or messaging features; and do not interfere with the Service's operation, security, or other users.
  • Moderation. We may remove content or suspend accounts that violate these Terms, but we are not obligated to monitor content.

9. Group riding and sharing

Group riding and share links let you share information — including your real-time location during a group ride, or a tracking link — with people you choose. You control when you share. Anyone with a valid share link can view what that link contains until it expires or you revoke it. Use these features thoughtfully and only with people you trust.

10. Intellectual property and attributions

The OpenRydr name, logo, tagline, app, and original content are owned by OpenRydr LLC and are protected by intellectual-property laws. These Terms do not grant you rights to our brand except as needed to use the Service.

OpenRydr is built with open data and open-source software, including OpenStreetMap data (© OpenStreetMap contributors), MapLibre, GraphHopper, and other components, each used under its respective license. Attributions are provided in the app.

11. Third-party services

The Service relies on third parties — including Apple, Google, Stripe, our SMS provider, and your mobile carrier. Your use of those services is subject to their own terms, and we are not responsible for them.

12. Apple App Store

If you download or use the OpenRydr app from the Apple App Store, the following additional terms apply, and apply only to your use of the iOS app:

  • This agreement is between you and OpenRydr only, and not with Apple. Apple is not responsible for the app or its content.
  • Apple has no obligation to provide any maintenance or support services for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the app's purchase price to you (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are OpenRydr's responsibility.
  • OpenRydr, not Apple, is responsible for addressing any claims relating to the app or your use of it, including (a) product-liability claims, (b) any claim that the app fails to conform to any applicable legal or regulatory requirement, and (c) claims arising under consumer-protection, privacy, or similar legislation.
  • If a third party claims that the app or your use of it infringes that third party's intellectual-property rights, OpenRydr, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim to the extent required by these Terms.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms when using the app (for example, your wireless data plan's terms).
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

13. Export compliance

You may use the Service only in compliance with U.S. export-control and sanctions laws. You represent that you are not located in, and will not use the Service from, a country subject to a U.S. Government embargo, and that you are not on any U.S. Government list of prohibited or restricted parties.

14. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that routes, maps, or safety features will be accurate or reliable.

15. Limitation of liability

To the maximum extent permitted by law, OpenRydr and its members will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid OpenRydr in the 12 months before the claim or USD $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless OpenRydr LLC and its members from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of another.

17. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or its users. Sections that by their nature should survive termination (including content licenses already granted, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

18. Dispute resolution

Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Minnesota, and you and OpenRydr consent to the personal jurisdiction of those courts, except where applicable law gives you the right to bring a claim elsewhere.

19. Governing law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your place of residence apply.

20. Changes to these Terms

We may update these Terms as the Service evolves. When we make material changes, we will update the “Last updated” date and provide notice where appropriate. Your continued use of the Service after changes take effect means you accept the updated Terms.
